Terms of Service

These Terms of Service (ToS) govern orders placed through EuropeanPeptides and define the contractual framework, usage restrictions, and special provisions for research chemicals and peptides.

1. Scope of Application

The following Terms of Service (ToS) apply to all orders placed via the online shop, both for consumers and entrepreneurs.

With regard to entrepreneurs, the following applies: any conflicting or supplementary general terms and conditions shall not become part of the contract. Their application is hereby expressly rejected unless expressly agreed to in writing.

2. Contractual Partner, Conclusion of Contract, and Correction Options

The purchase contract is concluded with the seller, Mr. Benjamin Frömcke.

By listing the products in the online shop, the seller makes a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your order by using the correction tools provided for this purpose.

The contract is concluded when you accept the offer by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language and Storage of the Contract Text

The languages available for the conclusion of the contract are German and English.

4. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. See link.

Entrepreneurs are not granted any voluntary right of withdrawal.

5. Retention of Title

The goods remain the property of the seller until full payment has been made.

For entrepreneurs, the following also applies: the seller retains title to the goods until all claims arising from the business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to us in advance all claims arising from such resale, irrespective of any combination or mixing of the goods subject to retention of title with a new item, in the amount of the invoice total, and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you fail to meet your payment obligations. At your request, we will release the securities to which we are entitled insofar as the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

6. Transport Damage

For consumers, the following applies: obvious transport damage must be reported immediately to the delivery service and notified to us without delay. Failure to make such a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance provider.

For entrepreneurs, the following applies: the risk of accidental loss and accidental deterioration passes to you as soon as we have handed over the goods to the freight forwarder, carrier, or any other person or institution designated to carry out the shipment.

7. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Special Provisions for Research Chemicals and Peptides

The following sections apply specifically to research chemicals and peptides offered through this website.

8. Intended Purpose

The products offered, in particular peptides and research chemicals, are intended exclusively for laboratory, research, and analytical purposes.

9. Prohibited Uses

Any use for human or animal consumption, as well as for medical, veterinary, cosmetic, or nutritional purposes, is prohibited.

Application to or in living organisms is not permitted.

10. Age Restriction

The purchase of the products is permitted exclusively to persons of legal age. By placing an order, the buyer confirms that they are at least 18 years old.

11. Use at Own Responsibility

The buyer undertakes to use the products exclusively for their intended purposes and within the framework of applicable law.

Any other use is at the buyer’s own responsibility.

12. Disclaimer of Liability

To the extent permitted by law, the provider assumes no liability for direct or indirect damages, consequential damages, losses, or any other consequences or disadvantages resulting from improper or unintended use of the products.

13. Storage and Disclaimer of Liability

The products are sensitive laboratory products and must always be stored properly, in particular in a cool, dry place, protected from light and free from vibration.

Improper storage may impair the stability, purity, effectiveness, or quality of the products. No liability is assumed for damages resulting therefrom, in particular for damage or loss of function caused by improper storage.

14. Buyer’s Legal Responsibility

The buyer is obliged to inform themselves about the legal permissibility of purchase, possession, import, and use in their respective jurisdiction.

By placing the order, the buyer confirms that the purchase and intended use of the products at the place of delivery comply with all applicable legal provisions, regulations, and official requirements.

The provider assumes no liability or warranty for legal permissibility outside its country of establishment.

15. Customs and Import

The provider is not liable for delays, inspections, seizures, or rejections by customs authorities or other supervisory authorities.

In such cases, there is no entitlement to a refund of the purchase price or replacement delivery.

16. Prohibition of Resale

The transfer, resale, or distribution of the products to third parties for consumption, medical, or other end-user purposes is prohibited without the express written consent of the seller.

17. Notification of Defects Upon Delivery

If products appear externally damaged or leaking upon receipt, the buyer must inform the seller by email within 24 hours of delivery. After this period, no complaint regarding transport damage can be considered.

18. Product Information

All product descriptions, analytical values, and other information provided on the website are for informational purposes only and do not constitute either a recommendation for use, instructions for use, or a guarantee of quality.

19. Storage, Handling, and Disposal

The buyer is solely responsible for the proper storage, handling, compliance with suitable safety measures, and proper disposal of the products in accordance with the applicable legal provisions and recognized laboratory and safety standards.

20. Withdrawal After Shipment

Withdrawal or refund after the goods have been shipped is excluded, unless mandatory statutory provisions provide otherwise.

21. Force Majeure

The provider is not liable for disruptions in performance, unavailability, or delays caused by force majeure or other unforeseeable events beyond the provider’s control, in particular official measures, disruptions in the supply chain, or delays caused by transport companies.

22. Severability Clause

Should any provision of these terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a provision shall be deemed agreed that comes closest to the economic purpose of the original provision.

23. Acceptance of the ToS

By placing an order, the buyer confirms that they have fully read, understood, and bindingly accepted these Terms of Service.
